The Ministry of Labor and Employment has finalized rules under four labor codes. This will pave the way for reforms to become reality by notifying them of their implementation soon. Under the new rules the government can change the existing overtime time limit. According to the new rules, if the work is more than 15 minutes beyond the specified hours, it is classified as overtime and the company must pay the employee.

According to information obtained through Hindustan sources, the government may change the existing overtime time limit under the new rules. The new rules state that if the specified hours are worked more than 15 minutes, it is included in the overtime category and the company has to pay the employee instead. This time limit was half an hour. The Ministry of Labor has completed consultations with all stakeholders in this regard. According to the officer in charge of the case, all procedures will be completed by the end of this month and the process of enforcing the rules can begin. The government hopes that with these new regulations, with the improvement of business activities, the status of workers will also change.

Profit for contract workers

According to the new laws, it is scheduled to provide a large compensation to those who work under contract or under third party. In this, such provisions are made so that the person working in the contract cannot be paid. After a meeting with the government, trade unions and industry, it was agreed that only the major employers, i.e. companies, would ensure full pay.

PF and ESI facilities

Employees are advised to make rules to ensure the management of facilities such as PF and ESI. With the new provisions, the government intends to prevent the company from claiming that the company can no longer provide facilities such as PF and ESI to contractors or third-party employees.

Wages, Industrial Relations, Social Security and Safety Four comprehensive codes of occupational safety and health and working conditions (OSH) have already been announced after the President’s approval. But in order to implement these four codes the rules need to be stated. The ministry has now completed the consultation process on the drafting of four codes.

The necessary rules for the implementation of the four labor codes have been finalized. We are ready to convey these terms. States are doing their job to strengthen the rules under the four codes. Parliament passed four broad codes on wages, industrial relations, social security and safety, occupational safety and health and working conditions (OSH), which ultimately rationalize 44 central labor laws. If the Parliament adopts the Wage Code in 2019, the remaining three codes will be approved by both Houses in 2020. The ministry wants to implement all four codes simultaneously.
