Letter to States and Union Territories of the Ministry of Home Affairs – Ensuring the Protection and Rehabilitation of Gender

The Home Ministry has written a letter to all chief secretaries of the central provinces and states, which advocates the protection of the rights of persons of the sexes and sensitize police and prison officials in this regard. All states need to protect and rehabilitate transgender people, the ministry said.

The Home Ministry wrote in its letter, “The law is mandatory to take adequate measures not only for state governments / UTs but also for welfare measures.

The Home Ministry has said that under Section 18 of the Transgender (Rights Protection) Act, 2019, the government is required for any person to engage in forced labor or forced labor other than any compulsory service for public purposes. T is a punishable offense when a person is forced or harassed.

When describing this act, it falls into the category of punishable offense if a person deprives a person of his or her right to public access or prohibits such person from visiting or using any public place where other members have access or use.

The Home Ministry has said that a transgender person is guilty of harming or injuring life, safety, health or welfare, including mental or physical abuse, sexual harassment, verbal and emotional abuse and financial abuse.

The letter states, “Rule 11 provides for adequate measures to prevent the discrimination of persons of color, including police directors, in establishing and supervising a Tigress Protection Cell under the District Collector in each district.

The Home Ministry said it was “urgently required to take the necessary steps in the wake of the Act and to initiate necessary sensitization programs for police and prison officials.”
