The Supreme Court has ruled that compensation for loss of spousal happiness will only cover loss of love and love, for which separate compensation cannot be fixed by making a separate item. Saying this, the court set aside the High Court order granting compensation for loss of love and loss with loss of spousal pleasure.

The court said that there should be a uniform system of compensation. It has already been decided that in case of death in a road accident, compensation will be fixed in three items. These items are loss of property, loss of companionship (happiness of the couple, the happiness of parents and happiness with siblings), and funeral expenses. The cost of loss of love and love is included in the said partner, it cannot be made a separate item.

The High Court and Motor Tribunal can get compensation for loss of lost couple happiness and other happiness, but it cannot be compensated separately for loss of love. The court gave this decision on the appeal of both the insurance company and the aggrieved party. 

This is the case, the victim’s husband died in a road accident in 1998. The victim’s husband worked in Qatar and was on leave in Rajpura, Punjab. The Motor Claims Tribunal ordered compensation of Rs 50 lakh but the wife appealed to the High Court. The High Court extended the compensation against which the insurance company came to the Supreme Court.
