The bench, comprising justices AS Bopanna and V Ramasubramanian, said, “We are seeking to discourage the application of Article 32 (Supreme Court’s power to redress fundamental rights violation).”
This is the case of a journalist being detained and similar petitions have been seen in the past, Sibal said. Kappan has been charged under the Unlawful Activities (Prevention) Act (UAPA) for having links with the banned organization Popular Front of India (PFI).
